TERMS AND CONDITIONS OF ONLINE SHOP MIRAMEDTECH
§1 Definitions
Rules - these regulations.
Customer - a natural person, legal person or organisational unit without legal personality, but with the capacity to perform legal acts, which under the terms of these Regulations places an Order in the Online Store
Consumer - a client who is a natural person using the Internet Shop for the purpose not directly connected with his/her economic or professional activity
Service Provider - an entity providing sales services via the Online Store under the terms specified in these Terms and Conditions.
Object of transaction - Goods listed and described on the website of the Store
Goods - movable thing, presented in the Internet Shop, to which the Sales Agreement applies.
Online Store (Store) - the website available at shop.miramedtech.com, through which the Customer may place an Order.
Order - Customer's declaration of will specifying unambiguously the type and quantity of Goods, aiming directly at concluding a Sales Agreement.
§2 General provisions
A) MIRAmedtech online shop [hereinafter "Store"] conducts retail sales via the Internet on the basis of these Regulations [hereinafter "Regulations"]. 2.
B) The Store is owned by: MIRAmedtech with its registered office in Königsbach-Stein at Heckwiesenweg 1, email address: shop@miramedtech.com [hereinafter "Service Provider"] .
C) The Terms and Conditions are an integral part of the sales contract concluded with the Customer.
D) The conclusion of a contract of sale is conditional on the Customer's acceptance of the Terms and Conditions.
E) All Goods offered in the Store are brand new, originally packed, free from physical and legal defects, and have been legally introduced into the Polish market.
§3 Orders
A) Prices given in the Store are gross prices (including VAT). 2.
B) Orders can be placed via the form available on the Store's website, by e-mail or by phone. 3.
C) A condition for the fulfilment of an order is that the Customer provides data which makes it possible to verify the Customer and the recipient of the goods. The Store confirms acceptance of the order by e-mail or telephone. Shop has the right to refuse orders, limit the method of payment or prepayment request when the order raises reasonable doubts about the validity and reliability of the data or method of payment.
D) The parties are bound by the information contained on the Store's website next to the purchased product at the time of order placement, in particular: the price, product characteristics, its features, elements included in the set, delivery date and method.
E) When placing an order, the Customer makes an offer to buy a particular product. The contract of sale is concluded when the Customer confirms the Order by clicking the confirmation link in the e-mail sent to the Customer by the Store.
§4 Payments
A) The Customer can choose the forms of payment specified in the Forms of payment tab. 2.
B) Shipping prices are specified in the delivery price list and during placing the order.
C) The condition of issuing the goods is payment for the goods and shipping.
D) We issue a VAT invoice for each product sold.
§5 Costs and date of shipment
A) The shop sends ordered goods through courier companies. 2.
B) In case of payment by credit card, the order processing time is counted from the moment of positive authorisation of the transaction.
C) In the case of payment other than cash on delivery, the shipping time is extended by the period between placing an order and the date of crediting the due amount to the Store's bank account.
D) The Customer is charged for delivery (dispatch) after agreeing the delivery costs with the Store.
E) The order lead time depends on the chosen form of payment and type of shipment. The customer can check the lead time by clicking on the link "Lead time".
§6 Complaints
A) If the goods are not in accordance with the contract, the Customer should send back to the Store, at the Store's expense, the advertised goods together with a description of the non-conformity.
B) The Store responds to the Customer's complaint within 14 days of returning the goods together with a description of the non-conformity.
C) If the fulfilment of a justified complaint involves sending a new product to the Customer or remedying the defects, the costs of delivery are paid by the Store.
§7 Privacy and personal data protection
A) Personal data provided to us by Customers in connection with registration and use of the MIRAmedtech Online Shop are processed by the Service Provider, who is the Personal Data Administrator in accordance with the GDPR. Only authorised employees of the Store have access to the database. More information about the processing of personal data in the Privacy Policy.
B) By placing an order, the Customer agrees to the processing of his/her personal data solely for the purpose of carrying out the order.
C) The Customer may also give separate consent to receive advertising and promotional materials, including a trade newsletter, from the Store.
D) The Customer has the right to access his/her personal data and correct it, to demand to stop processing it and to object to its processing,
E) The shop does not pass on, sell or lend collected personal data of customers to third parties, except with the express consent or at the request of the customer or at the request of legally empowered state authorities in connection with ongoing proceedings,
F) In order to carry out the ordered shipments, personal data may be provided to the courier company.
G) For the purpose of payment, personal data may be transferred to PayPal if the customer chooses this form of payment.

§8 Intellectual property
It is forbidden to use any materials published on the Store's website (including photos and descriptions of goods) without the Store's written consent.
§9 Entry into force and amendments to the Terms and Conditions
A) The Regulations come into force as of the date of publication on the Store's website.
B) These Regulations may be amended.
C) Changes in the Regulations will be published on the Store's website.
D) Information about changes to the Terms and Conditions will be sent to the Customer at the email address specified in the order.
E) The Store recognises that the Customer has accepted the changes to the Regulations if he or she has not terminated the contract by the end of the period indicated in section 5.
§10 Final provisions
Any disputes related to the services provided by the Store will be settled by the common courts.
